These Terms and Conditions govern your access to and use of the Rigged marketplace.
In these Terms, “Rigged”, “we”, “us” and “our” refer to RIGGED LIMITED. “User”, “you” and “your” means anyone who accesses or uses Rigged. A “Buyer” is a User who purchases an item and a “Seller” is a User who lists or sells an item. A User may be both a Buyer and a Seller.
By creating an account, listing an item, purchasing an item or otherwise using Rigged, you agree to these Terms and the policies that apply to your use of the marketplace.
Sellers must also comply with the applicable Seller requirements and policies.
If you do not agree to these Terms, you must not use Rigged.
Rigged is an online marketplace designed to allow Users to buy and sell gaming hardware and related products.
Rigged provides marketplace technology and services including User accounts, Seller identity verification, listings, checkout, payment processing through Stripe, shipping-label generation, tracking and order-management tools.
Unless a listing expressly identifies Rigged as the Seller, Rigged does not own, hold, warehouse or sell the goods listed by Users.
The contract for the purchase of an item is between the Buyer and the Seller identified on the relevant listing and order.
You must be 18 years of age or older to use Rigged.
You must provide accurate and truthful information when creating and using your account. You must not impersonate another person, use another person’s identity, create accounts to avoid a restriction or suspension, or use Rigged for unlawful purposes.
You are responsible for maintaining the security of your account and should not allow another person to use your account improperly.
We may restrict, suspend or terminate an account where reasonably necessary to protect Users, Rigged, our service providers or the marketplace.
Before selling through Rigged, Sellers must complete the required identity-verification process and connect the required Stripe account.
Sellers are responsible for ensuring that they own or otherwise have the legal right to sell every item they list.
Listings must accurately represent the item being sold. Photographs, descriptions and condition information must be truthful, used products must be appropriately described as used and known faults must be disclosed.
Sellers are responsible for the goods they sell and for complying with applicable law.
Additional requirements applying specifically to Sellers may be contained in Rigged’s Seller Terms or other Seller policies.
Users selling items privately and Users selling in the course of a business may have different legal obligations.
If you sell through Rigged in the course of a business, you are responsible for identifying yourself appropriately as a trader and complying with the legal obligations that apply to you.
A User must not represent themselves as a private Seller where they are actually acting in the course of a business.
Where a Seller is acting as a trader, consumer protection legislation may provide Buyers with additional rights, including rights under the Consumer Rights Act 2015.
Nothing in these Terms removes statutory rights that cannot legally be excluded.
Before purchasing an item, Buyers are responsible for reviewing the listing, photographs, description, condition information and available Seller information.
The total amount payable will be displayed during checkout before payment is completed. This may include the item price, shipping and any other charge displayed by Rigged.
Payments are processed through Stripe.
Buyers should only complete a purchase if they are willing to inspect the item after delivery and use Rigged’s order process if there is a problem.
Payment for an order does not mean that the Seller immediately receives the funds in their bank account.
Seller payout eligibility is connected to the status of the order and Rigged’s Buyer inspection process.
Where there is an eligible refund request, dispute, fraud review or other valid hold, Seller payout may remain on hold while the issue is reviewed.
After an order becomes eligible for payout, Stripe, banks, verification processes and risk controls may affect how long it takes for the money to reach the Seller’s bank account.
A new Seller’s first bank payout may take up to seven days because of Stripe’s checks on new connected accounts. This is separate from Rigged’s inspection period.
When delivery is confirmed by carrier tracking or another Rigged-approved delivery event, a 72-hour (3-day) inspection window may begin.
During this period, the Buyer should inspect and, where appropriate, test the item.
If the item is faulty, damaged or materially not as described, the Buyer should report the problem using the appropriate Rigged order tools during the inspection window.
A Buyer may confirm earlier that the item has been received and is in working order.
If the Buyer confirms that the item is satisfactory, or the inspection window expires without an eligible refund request, dispute, fraud review or other valid hold, the order may become eligible for Seller payout.
Orders must use the applicable shipping process provided through Rigged.
Sellers are responsible for properly packaging their items and using the appropriate shipping label for the order.
Delivery is carried out by independent carriers. Rigged is not a courier and does not hold Seller stock while it is in transit.
Tracking information is provided by the carrier or shipping provider and delivery times are estimates.
Original outbound shipping is refundable under Rigged’s standard process only where the outbound label remains unused, is still pre-transit and can be cancelled.
Once the outbound label has been used, or the parcel is in transit or has been delivered, original outbound shipping is not refunded under Rigged’s standard process, subject always to applicable law.
Returns must be handled through the applicable Rigged order process.
Where an item is eligible for return because it is faulty, damaged or materially not as described and the issue is reported through Rigged during the applicable inspection window, the Seller is responsible for the return shipping label.
For purchases from private Sellers, a change of mind does not automatically entitle the Buyer to return an item.
A private Seller may refuse a change-of-mind return. If the Seller agrees to accept the return, the Buyer is responsible for the return shipping label under Rigged’s standard process.
Additional or different rights may apply where the Seller is acting as a trader.
Full details are provided in our Returns and Disputes Policy.
Refunds are handled in accordance with Rigged’s Refund Policy and applicable law.
Stripe incurs a payment-processing cost when the Buyer pays. Under Rigged’s standard process, this processing cost may be retained from a refund where the law allows.
If applicable law requires a different refund amount, the law takes priority.
Original shipping may be refunded where the outbound shipping label remains unused, is still pre-transit and is successfully cancelled. Once the label has been used or the parcel is in transit or delivered, original shipping is not refunded under Rigged’s standard process, subject to applicable law.
Full details are provided in our Refund Policy.
Where there is a problem with an order, Users should use the dispute and support processes provided through Rigged.
Rigged may keep an order or Seller payout on hold while reviewing a reported problem, return, missing parcel, suspected fraud or other relevant issue.
Buyers and Sellers must provide truthful information when raising or responding to an issue.
Rigged may request information reasonably necessary to understand the issue and determine how the marketplace process should proceed.
Further information is provided in our Returns and Disputes Policy.
Rigged may charge Sellers fees or commission for transactions completed through the marketplace.
Stripe may separately charge payment-processing costs. Seller earnings displayed through Rigged may therefore be shown after applicable Rigged commission and Stripe processing costs.
Applicable prices, fees or charges will be displayed or otherwise made available through Rigged where appropriate.
Users must not attempt to avoid applicable marketplace fees by moving a transaction or payment outside Rigged.
Rigged must not be used for fraud, attempted fraud or other unlawful activity.
Users must not list stolen, counterfeit or illegal goods, knowingly misdescribe products, manipulate reviews, harass other Users, arrange or solicit off-platform payment, attempt to avoid marketplace fees or interfere with the security or operation of Rigged.
Rigged may remove listings, restrict or suspend accounts, stop or hold payouts and retain relevant records where reasonably necessary to protect Users or the marketplace.
Suspected fraud or criminal activity may be reported to law enforcement or other appropriate authorities where necessary or required by law.
Reviews must relate to genuine Rigged transactions and must not contain deliberately false, abusive or unlawful material.
Users are responsible for content they submit to Rigged, including listing information, photographs, messages and reviews.
Rigged may remove or restrict content that breaches these Terms or applicable law.
Users must not use Rigged’s communication systems to facilitate fraud, harassment, prohibited transactions or attempts to move payments outside the marketplace.
Rigged provides features intended to reduce the risks associated with peer-to-peer marketplace transactions.
These may include Seller identity verification, payment processing, tracked shipping, the 72-hour inspection period, payout controls and tools for reporting problems.
These measures are designed to reduce risk but do not guarantee that every User, listing or item is genuine, lawful, fault-free or as expected.
Buyers remain responsible for reviewing listings before purchasing and inspecting their goods after delivery.
Further information is provided in our Buyer Protection Policy.
Rigged relies on third-party providers to operate parts of the marketplace.
These include Stripe for payments, identity verification and connected Seller accounts, and Shippo and relevant delivery carriers for shipping labels and tracking.
Third-party services operate independently and may be subject to their own terms, privacy policies, availability and technical limitations.
Where Sellers select or use a carrier through Rigged, they may also be required to accept that carrier’s applicable terms.
Rigged may provide an automated assistant or other automated functionality to help Users navigate or understand the marketplace.
Any on-site assistant is automated. It is not a person, does not provide legal advice and does not make final decisions regarding transaction disputes.
For actual problems with an order, Users should use the relevant Rigged order or support process.
Rigged may restrict, suspend or terminate a User’s access where reasonably necessary to protect Users, Rigged, our service providers or the marketplace.
This may include circumstances involving suspected fraud, illegal activity, prohibited goods, attempts to bypass marketplace fees, misuse of accounts, false information, abuse of other Users or breaches of these Terms.
Where appropriate, Rigged may also remove listings, restrict marketplace functionality or hold payouts associated with an unresolved transaction or investigation.
Termination of an account does not remove obligations, liabilities or rights that arose before the account was terminated.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence or liability for fraud.
Subject to applicable law, Rigged is responsible for loss that is a reasonably foreseeable result of our breach of these Terms or a duty imposed on us by law.
Rigged is not responsible for losses outside our reasonable control, including carrier delays.
Responsibility for goods listed and sold through Rigged sits with the Seller, subject to applicable law.
Rigged processes personal information in accordance with our Privacy Policy.
Personal information may be processed where necessary to operate accounts, facilitate transactions, process payments, perform identity checks, provide shipping and tracking, manage payouts, prevent fraud, resolve disputes and operate the marketplace.
Information about cookies and similar technologies is provided in our Cookie Policy.
We may change or update Rigged and these Terms where reasonably necessary, including to reflect changes to marketplace functionality, service providers, legal requirements, security measures or our business operations.
Where appropriate, material changes to these Terms will be notified to Users.
The revision date shown at the top of this page identifies the current version. Changes to these Terms do not remove rights that arose before the change.
These Terms are governed by the laws of England and Wales.
Nothing in these Terms or Rigged’s other policies excludes, restricts or overrides mandatory consumer protections or other rights that cannot legally be excluded.
Where applicable law gives a Buyer or Seller rights that differ from Rigged’s standard marketplace process, those legal rights continue to apply.
These Terms and Conditions should be read alongside Rigged’s Buyer Protection Policy, Privacy Policy, Cookie Policy, Disclaimer, Refund Policy and Returns and Disputes Policy.
Sellers must also comply with any Seller Terms or Seller-specific requirements that apply to their use of Rigged.
Together, these documents explain the rules and processes applying to the use of the Rigged marketplace.
